New York Governor Rightly Vetoes Bad Special Education Bill | NSEL


New York Governor Andrew Cuomo rightly vetoed a bill that would have required public school officials to take into account "the home life and family background" of special education students when placing them in schools. ?The backers of this bill sought to have special education students placed in private, religious schools and make the taxpayers pay for it. ? IDEA already requires private outside placement of a Special Education student when the public school district can not provide the needed services.

However, whether a student would be more comfortable in a religious school, should not be included in the criterion of whether a private placement is necessary. ?Special Education students face enough challenges without having to be used by those who seek taxpayer funding for parochial schools. ?If a parochial school can provide a Special Education student necessary services that the public school cannot, then placement would be acceptable. ?However, a student's religious background or family lifestyle should never be considered for placement.
